This Privacy Policy describes how Crosswalk Technologies, Inc., and its affiliates (“Company”, “we” or just “Crosswalk”) collect, use, treat, process and discloses personal information and business information, on or through our websites, services, products, databases, software, tools and apps where this Privacy Policy is located or referenced (“Platform”) and in our offline interactions where this Privacy Policy is referenced. 

There are many reasons we track your digital ecosystem usage, browsing activity, and actions and collect your personal data. Our primary purpose is to take your data, combine it with data from like-minded individuals and then find useful patterns in the data that we can sell to our clients for various use cases. In some cases, those reasons are simply to make your browsing experience better and more convenient. But this data can also be used to determine your browsing habits and preferences, price points you like to pay, what size you are, and other personal information that can then be used by brands and advertisers in determining how to best design, produce, market and sell you the right products. This cuts down on wasting time, and money and creating an excess of product that ends up in a landfill to name only a few.

Our goal is to be able to accomplish this purpose with ethics. That means we are going to only analyze your data with your full consent and make our best effort for you to understand which data we are gathering, how we are processing it, and why we are doing it. 

This Privacy Policy does not apply to personal information we collect from our employees and contractors. This Privacy Policy is not a contract and does not create any legal rights or obligations.

This can help our clients include more relevant information on their products so that you don’t have to look for answers elsewhere, but it can also be used for advertising purposes.

Overall we are tracking how you use your digital ecosystem of devices to help brands become smarter, create less waste of products you don’t want, and give you a more seamless online experience.

The information we track is both sold raw and analyzed to a wide range of clients in a number of different sectors.

In addition to the uses described above, we may collect and use personal information for the following purposes:

  • For our business activities, including to operate our services and to provide our clients with the features and functionality of our services.

  • To help our clients make better strategic, design, product, financial and marketing decisions, such as to better understand how to market to you or offer you with information and updates on our products or services the data shows that you may be interested in.

  • While we may use your personal information in this manner, please note that we do not use user content to serve you ads, but we might share user content with any third parties for specific purposes unless you have explicitly submitted it to a request to “do not sell my personal information”.

  • For analytics and research purposes to enforce our Terms of Service, to resolve disputes, to carry out our obligations and enforce our rights, and to protect our business interests and the interests and rights of you, our clients, and other third parties.

WHAT WE TRACK, CAPTURE AND STORE

We may anonymize and aggregate any of the personal information we collect (so that it does not directly identify you). We may use anonymized information for purposes that include research, data analysis, improving our client’s brands, and helping them understand aggregate behavior. Please note that our systems may also record personal information that you type into our websites and other online services even if you do not choose to submit it.

We may and can identify you as an individual. We do not sell Personally Identifiable Information. Our primary goal is to understand how a group of people behave online and track trends and patterns. In order to do that and accomplish our targets and our client’s purposes we may use personal information. Please notice that by adding our platform extension to your browser or mobile device you are giving free consent for the treatment of the data that follows. You can always opt-out, restrict consent, and/or request to not sell your personal information accordingly to the sections below in this document.

INFORMATION FROM THIRD-PARTY SOURCES

We may receive personal information about you from our clients, business partners, and service providers and combine this information with other data we collect from you. The third parties may include website and service operators, payment processors, marketing partners, and our clients. The information may include contact information, demographic information, information about your communications and related activities, and information about your orders.

  • Account Creation / Single Sign-On. We may use single sign-on ("SSO") to allow a user to authenticate their account through their email. We do this by using OAuth authentication (or similar methods), a secure mechanism to give us access to your account data without letting us know your password.

  • We will have access to certain information from those third parties in accordance with the authorization procedures determined by those third parties, including, for example, your username, password, name, email address, and profile picture.

  • Information from Other Sources. We may obtain information from other sources, including third-party information providers, customers, public sources, or through transactions such as mergers and acquisitions. We may combine this information with other information we collect from or about you. In these cases, our Privacy Policy governs the handling of the combined personal information.

We use this information to operate, maintain, and provide you and our clients with the features and functionality of our services.

HOW WE SHARE PERSONAL INFORMATION

We may also share, transmit, disclose, grant access to, make available, and provide personal information with and to third parties, as described below.

  • Service Providers - we may share personal information with third-party contractors and service providers who perform services on our behalf, or in partnership with us which are subject to reasonable confidentiality terms.

  • Clients - we may disclose non-identifiable and identifiable personal behavioral information from data we’ve gathered through your consent to our clients.

HOW LONG WILL WE STORE YOUR PERSONAL INFORMATION

  • We will usually store the personal information we collect about you for no longer than necessary for the general course of our business needs and in accordance with our legal obligations and legitimate business interests.

  • The criteria used to determine the period for which personal

information about you will be retained varies depending on the legal basis under which we process the personal information:

    • Consent. We are processing personal information based on your consent, we generally will retain the information until you withdraw your consent, or otherwise for the period of time necessary to fulfill the underlying nature of our business.

STORING AND TRANSFERRING YOUR PERSONAL INFORMATION

  • Security. We implement appropriate technical and organizational measures to protect your personal information against accidental or unlawful destruction, loss, change, or damage. Nonetheless, it is important for you to know that Any transmission of your data to our Platform is at your own risk, and your use of the platform indicates your agreement to assume this risk. We encourage you to use caution when using the platform, being aware of everything informed throughout this document. We keep personal information as long as it is necessary or relevant for the practices described in this Privacy Policy, including, for example, for legal compliance, dispute resolution, contract enforcement, backup, archival, and other internal operations purposes.   • All personal information we collect will be stored in our cloud hosting provider on secure servers.

  • We will never send you unsolicited emails or contact you by phone requesting credit or debit card information or national identification numbers.

  • International Transfers of your Personal Information. The personal information we collect may be transferred to and stored in countries outside of the jurisdiction you are in where we and our third-party service providers have operations. If you are located in the EEA, United Kingdom, or Switzerland, your personal information may be processed outside of those regions, including in the United States.

  • In the event of such a transfer, we ensure that: (i) the personal information is transferred to countries recognized as offering an equivalent level of protection; or (ii) the transfer is made pursuant to appropriate safeguards, such as standard data protection clauses adopted by the United States the European Commission.

CALIFORNIA RESIDENTS SPECIFIC PRIVACY RIGHTS 

California residents are granted specific rights concerning access to their personal information, according to the CCPA (California Consumer Privacy Act).

- every individual who is in the State of California for other than a temporary or transitory purpose and

- every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose.

WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION? 

We only process your personal information when it is necessary and when we have a valid legal reason (also known as a legal base to do so under applicable law. PARENTAL CONTROL AND CONSENT 

We don’t collect and process personal identifiable data of minors (under 16 years old by data protection laws). We may process aggregate anonymized data as long as the following is observed. 

Children’s Online Privacy Protection Act (COPPA)

COPPA requires the posting of clear and comprehensible privacy policy that explains how the personal information of kids under 13 is handled. Direct notice of the information practices must be given to parents before the collection of their child’s data, and the parent’s verifiable consent obtained. Additionally, parents have ongoing rights to review the personal information collected about their child, revoke consent, and delete their child’s personal data. Health Insurance Portability and Accountability Act of 1996 (HIPAA)

We may collect medical history information from healthcare providers, facilities, plans, clearinghouses, and business associates. We may collect a complete health record including, but not limited to, diagnoses, lab test results, treatment, and billing records for all conditions.
